OSHA's Emergency Temporary Standard for Healthcare

OSHA has created an Emergency Temporary Standard (ETS) for healthcare workers and updated guidance for workplaces. The ETS is effective immediately upon publication in the federal register.

Key Points:

Who it affects 29 CFR 1910.502 (a)

  • The ETS applies to employees who provide health services or healthcare support services employees in hospitals, nursing homes, assisted living, emergency responders, home healthcare workers and employees in ambulatory care facilities except:
    • First aid performed by employee who is not a licenses healthcare provider
    • Pharmacists 
    • Non hospital ambulatory care settings where non employees are screened and those suspected or confirmed COVID-19 are not aloud to enter
    • Well Defined hospital ambulatory care settings where employees are vaccinated and non employees are screened and those suspected or confirmed COVID-19 are not aloud to enter
    • Home Healthcare settings where all employees are vaccinated and non employees are screened those suspected or confirmed COVID-19 are not aloud to enter
    • Healthcare support services that are offsite
    • Telehealth services performed offsite

    COVID 19 Plan 29 CFR 1910.502 (c)

    • Employer must develop and implement a COVID-19 plan 
    • Must be a written plan if you have more than 10 employees
    • Employer must designate one or more workplace COVID-19 safety coordinator
    • Employer must conduct a workplace-specific hazard assessment to identify potential hazards
    • To be exempt from providing control employer must provide fully vaccinated status
    • Employer must seek input from non-managerial employees on the development of the COVID-19 plan
    • Employer must monitor COVID-19 plan effectiveness and change as needed 

    Sections in COVID-19 Subpart U

       •   Healthcare
             o   Applies to all setting where employees provide healthcare services or support services except in situations provided above
       •   Mini Respiratory Protection
             o   Provides requirements for situations where respirators are used in accordance with 1910.502
       •   Severability
             o   Each Sub section of Subpart U and every provision within is separate and servable from the other sections
       •   Incorporation by Reference
             o   Materials adopted as part of the ETS
                      Centers for Disease Control and prevention
                      Consensus standards for PPE (Personal protective Equipment)
                      EPA list of approved disinfectants

        Important Dates

           •   All Provision go into effect 14 days after date of publication in the Federal Register except
                 •   Physical barriers (29 C.F.R. § 1910.502(i))
                 •   Ventilation (29 C.F.R. § 1910.502(k))
                 •   Training (29 C.F.R. § 1910.502(n))
           •   Those paragraphs will go into effect 30 days after date of publication in the Federal register
